Right of cancellation for consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, commercial or independent professional activity.

Right of cancellation

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the date,

• on which you or a third party named by you, who is not the carrier, have taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are or will be delivered uniformly, or
• on which you or a third party named by you, who is not the carrier, have taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately, or
• on which you or a third party named by you, who is not the carrier, have taken possession of the last partial consignment or the last item, if you have ordered goods that are delivered in several partial consignments or items, or
• on which you or a third party named by you, who is not the carrier, have taken possession of the first goods, provided that you have concluded a contract for the regular delivery of goods over a fixed period of time.

To exercise your right of cancellation, you must inform us (MRS Electronic GmbH & Co. KG, Klaus-Gutsch-Str. 7, 78628 Rottweil, Germany, telephone number: +4974128070, e-mail address: shop@mrs-electronic.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, e-mail). You can use the attached sample cancellation form, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

The right of cancellation does not apply to contracts for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

Consequences of cancellation

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery charges (other than any additional charges arising from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date on which we receive notice of your revocation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no circumstances will you be charged for this refund. We may refuse to make any refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
